According to Article L.510-1 of the French Mutual code, the control of the State over mutual organisations, unions and federations governed by the French Mutual Code is practiced in favour of their members and their heirs by the Prudential Supervisory and Resolution Authority “Autorité de Contrôle Prudentiel et de Resolution (ACPR)”.

Informatics and Freedom:

The processing of personal information collected by the mutual is carried out under the responsibility of the latter and exclusively for the purpose of managing the mutual in accordance with its purpose, in accordance with the provisions of Regulation No. 2016/679, known as the General Regulation on the Data Protection (RGPD) and any applicable French law or regulation.
The personal data held under the management account are exclusively used in the conditions where they would have been if the management had been carried out directly by the principal.
Unless previously agreed, no personal data processed or held may be transferred or made available to third parties for commercial purposes.
The Mutual has put in place technical, physical and administrative security measures to ensure the confidentiality of personal data processed or held.
Personal data are kept for the duration of their membership in the Mutual and for the duration of the limitation periods as set by law.
Any member of the mutual as well as any person, object of a management on behalf of third parties, can request communication and update or rectification of the personal data concerning it, held in the files of the mutual as well as, the case where appropriate, its agents and reinsurers. He may exercise this right of access and rectification by applying to the Mutual:

Withdrawal Terms:

Pursuant to Article L221-18 of the French Mutual Insurance Code and Article L121-29 of the French Consumer Code, all new members have fourteen (14) calendar days to cancel their subscription without giving any grounds or bearing any penalties. This timescale begins on the day the membership agreement is signed. The right of withdrawal is implemented by sending a signed-for delivery letter to MIS Santé’s headquarters: MIS Santé - Service Santé à l’étranger - CS 30041 - 13417 Marseille Cedex 08.  (The date when the letter is first presented for delivery will determine whether withdrawal took place within the requisite timescale.)

Pursuant to Article L121-29-II.2 of the French Consumer Code, any application made by a member during the withdrawal period for reimbursements or for direct payments of medical expenses will constitute an express, irrevocable request for implementation of the mutual insurance policy, entailing renunciation of the withdrawal right and its timescale.

On claims:

For all complaints regarding your Extra-Pass Special policy (marketing, contract, mutual insurance regulations, reimbursement, etc.) three ways to contact us are at your disposal:

Mis Santé will formally acknowledge your complaint within seven (7) days after which a response is sent as soon as possible. Upon reception of all necessary documents for the investigation and the treatment of your complaint, a response will be given to the insured within a month.
